Terms of service

These terms are the contract between you and BE PLUS S.R.L. for the use of boostyourlife4ever. Subscribing means you accept them, so read them first.

1. Who you are contracting with

boostyourlife4ever is operated by BE PLUS S.R.L., a company registered in Romania and identified in full at the top of this page. In these terms, "we" and "us" mean that company, and "you" means the business subscribing to the service.

These terms cover the website at boostyourlife4ever.com and the application behind it.

2. What the service does

You describe a brand once. Every Wednesday we generate the following week for that brand — five posts, one for each working day — each adapted to the social networks you have connected. You then have Wednesday, Thursday and Friday to edit, regenerate or approve them. From Monday they publish, one per working day, at nine in the morning in your organisation’s own timezone.

We publish to Facebook, Instagram and LinkedIn. Three connected accounts are included with every brand. We do not publish to any other network.

Posts are written by an automated language model from the description you give us. Until one is published it is a draft, and you can change or delete it.

3. Who may use it

The service is sold to businesses and other professionals rather than to consumers. You must be at least 18, and if you are acting for a company you must be authorised to enter into this contract on its behalf.

Signing in requires a Google account. It is the only sign-in method we offer.

4. Your account and your brands

Keep your account details accurate and your sign-in secure. Anything done through your account is treated as done by you.

You can invite other people into your organisation and give them access to specific brands. As between you and us, you answer for what they do: inviting somebody shares the work, not the responsibility. What you agree with them about that is between the two of you, and you can remove them at any time.

A brand may name a website, a shop or a domain only if it is yours, and we ask you to prove it with a DNS record. Until you do, we do not put that name into anything we generate, a post that mentions it waits for you to read rather than going out on its own, and the brand cannot be handed to somebody else to run. Naming a domain that is not yours is a breach of these terms.

Each brand occupies one brand slot, and the number of brands is the quantity your subscription is priced on. Drafts are free and uncounted; a brand starts costing when you activate it.

5. Connecting social accounts

Connecting an account authorises us to publish to it on your behalf. You can disconnect at any time, and disconnecting stops publishing to that account immediately.

We publish only what the service generated for that brand, and only to the accounts you connected. We do not read your private messages and we do not post anything you have not asked for.

We may use a third-party publishing provider to reach the networks. Each network’s own terms continue to apply to you, and a network may refuse, delay or remove a post for reasons of its own. That is outside our control, but we tell you when it happens.

6. What we generate, and who answers for it

We write; you decide what goes out. Anything published under your brand is yours, and you are responsible for it.

There are two ways for a post to be published, and the difference matters:

We mark generated text that names a price, a discount, a phone number, an email address, or a website that is not yours. Those are the lines that cause real harm when they are wrong. The mark is advice rather than a refusal: the post stays yours, to publish as it stands or to rewrite. With automatic publishing on there is one exception. A marked post is not published unread; it waits in the calendar for you. No automated check is complete, so if an unreviewed sentence published under your brand would cause you a problem, approve your posts yourself rather than turning automatic publishing on.

You keep whatever rights you have in the brand descriptions you write and in the posts we generate for you, and you may use them anywhere, including after you stop being a customer.

7. Prices, VAT and payment

Prices are shown on the pricing page in euro and exclude VAT. VAT is added at checkout at the rate of your own country, or the reverse charge applies if you are a business in another EU member state and give a valid VAT identification number.

The subscription is monthly and priced per brand, with a discount that grows with the number of brands. Payment is handled by Stripe. We never receive or store your card details.

Charges appear on your statement as BOOSTYOURLIFE4EVER. If you do not recognise a charge, write to us before disputing it with your bank — it is faster, and we can show you exactly what was published.

Adding a brand part-way through a month raises the quantity, and Stripe charges the difference for the remainder of the period.

8. Renewal, cancellation and refunds

The subscription renews every month until you cancel. You can cancel at any time from the billing page. Cancelling stops the next renewal; the period you have already paid for runs to its end, and posts already published stay published.

Two refunds are offered, and neither requires you to argue for it:

Refunds are returned to the card that paid, and Stripe usually takes five to ten working days to show them.

9. What we promise, and what we do not

We promise to publish what you approved, to the accounts you connected, at the schedule you are on, and to tell you when a network refuses a post or when a connection has expired and needs reconnecting.

We do not promise engagement, reach, followers, enquiries or sales, and we do not promise that a network will accept every post. Anyone promising those is guessing.

The service can be interrupted — by maintenance, by a failure at a network, or by a failure at a provider we depend on. We keep interruptions short and we do not hide them.

10. Acceptable use

Do not use the service to publish content that is unlawful, that infringes someone else’s rights, that impersonates a person or business you do not represent, that harasses or incites hatred, that is sexually explicit, or that makes health or financial claims you cannot support.

Do not attempt to break, overload, probe or reverse-engineer the service, and do not resell it as your own without a written agreement with us.

We may refuse or remove content that breaks this section, and we may suspend an account that keeps doing so.

11. Suspension and termination

You can stop whenever you like: cancel the subscription, and delete your account if you want it gone.

We may suspend or close an account that breaches these terms, that we are required by law to act on, or whose payment has failed and stayed unpaid after we have asked.

When a subscription lapses, brands stop generating and stop publishing, and connected accounts stop being used. What happens to your data afterwards is set out in the privacy policy.

12. Intellectual property

The service, its software, its design and the content of this site belong to us. While you are subscribed you have permission to use them for your own business; you do not acquire ownership of them.

Your brand, your descriptions and the posts we generate for you belong to you. You give us permission to store and process them in order to run the service, and to publish them to the accounts you connected.

13. Personal data

How we handle personal data is set out in the privacy policy, which forms part of these terms. Where we process personal data on your behalf — the content you publish and the accounts you connect — we act on your instructions and for no other purpose.

14. Changes

We may change the service and these terms. Changes that materially affect you are announced by email at least 30 days before they take effect, and you are free to cancel before that date.

A price change never applies to a period you have already paid for.

15. Sanctions and restricted territories

You may not use the service if you, your company or its beneficial owners are subject to sanctions imposed by the European Union, the United Nations, the United Kingdom or the United States, or if your business is established in a territory subject to comprehensive sanctions. We may refuse or end service in order to comply, and we may verify this.

16. Liability

Nothing in these terms limits liability that the law does not allow to be limited — including fraud, and death or personal injury caused by negligence.

Subject to that, our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

We are not liable for lost profit, lost business or lost goodwill, nor for decisions a social network takes about your account.

17. Governing law and disputes

These terms are governed by Romanian law, and the courts of Bucharest have jurisdiction.

Write to us before doing anything else. Almost everything is settled by email in a day or two, and we would rather fix a problem than argue about it.
